1. Parteien und Kontakt

eSIMSupra (the "Service", "we", "us", "our") is operated by the legal entity trading as eSIMSupra, contactable at [email protected]. "You" means the adult purchaser or user of a plan.

Operator note: replace with your registered company name, address, jurisdiction of incorporation, and company number before commercial launch.

2. Berechtigung

You must be at least 18 years old (or the age of majority in your country of residence if higher) to purchase a plan. By placing an order you confirm you meet this requirement and that you have legal capacity to contract.

Vorausbezahlte eSIM‑Datentarife digital geliefert.

Plan availability, included data, validity, speed, and supported carriers are listed on each plan page and may change over time. Network coverage is provided as-is and depends on local carrier infrastructure, your device's band support, and regional conditions beyond our control.

4. Bestellungen, Preise und Steuern

• Preise werden standardmäßig in USD und in Ihrer lokalen Währung angezeigt, sofern unterstützt. Die endgültige Abbuchung erfolgt in USD durch unseren Zahlungsanbieter; Bankumrechnung und FX-Spreads liegen außerhalb unserer Kontrolle.
• Steuern, Mehrwertsteuer oder GST sind, soweit anwendbar, entweder im angezeigten Preis enthalten oder werden an der Kasse hinzugefügt, wie Ihnen vor der Zahlungsbestätigung mitgeteilt.
• Eine Bestellung wird verbindlich, wenn wir Ihnen die Bestellbestätigungs-E-Mail senden. Wir behalten uns das Recht vor, eine Bestellung abzulehnen oder zu stornieren, wenn sie betrügerisch erscheint, Sanktionslisten verletzt oder aus einer gesperrten Gerichtsbarkeit aufgegeben wurde.

3. Rückerstattungen

Refund eligibility is governed by our Rückerstattungsrichtlinie, which forms part of these Terms. Where EU/UK consumer law grants a 14-day right of withdrawal for digital goods, you acknowledge that activating the eSIM profile begins performance of the service and therefore extinguishes that right for the activated plan, in line with Article 16(m) of Directive 2011/83/EU.

8. Geistiges Eigentum

The website, brand, logo, site copy, design, and software are the intellectual property of the operator of eSIMSupra and its licensors. You receive a limited, personal, non-exclusive, non-transferable licence to use the service. Nothing in these Terms transfers ownership of any intellectual property.

9. Garantien und Haftungsausschlüsse

To the maximum extent permitted by applicable law, the service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory — including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that coverage, speed, or availability will be uninterrupted or error-free. Nothing in this section limits any warranty that cannot lawfully be excluded in your jurisdiction.

5. Haftungsbegrenzung

To the maximum extent permitted by applicable law, our aggregate liability to you for any claim arising from the service is limited to the total amount you paid for the specific plan that gave rise to the claim within the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, missed bookings, roaming charges on your home carrier, or travel-plan disruption. Nothing in this section limits liability that cannot lawfully be limited, such as for death, personal injury caused by our negligence, or fraud.

11. Geltendes Recht und Streitigkeiten

These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-law rules. Any dispute will first be attempted to be resolved by good-faith negotiation between you and us for at least 30 days. If that fails, disputes will be resolved by the courts of that jurisdiction, except where mandatory local consumer-protection law grants you a right to your local court. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Operator note: specify the exact governing law and forum (e.g. "laws of England and Wales, courts of London" or "laws of Delaware, state and federal courts of Delaware") before commercial launch.

12. Kündigung

We may suspend or terminate the service or your access to any part of it at any time for breach of these Terms, legal compulsion, or security reasons. Sections that by their nature should survive termination (intellectual property, warranties, liability, governing law) will survive.

14. Sonstiges

• Salvatorische Klausel. Sollte ein Teil dieser Bedingungen für nicht durchsetzbar gehalten werden, bleibt der Rest wirksam.
• Gesamte Vereinbarung. Diese Bedingungen bilden zusammen mit der Datenschutzerklärung, der Cookie-Richtlinie und der Rückerstattungsrichtlinie die gesamte Vereinbarung zwischen Ihnen und uns.
• Kein Verzicht. Unser Versäumnis, eine Bestimmung durchzusetzen, bedeutet keinen Verzicht auf unser Recht, sie später durchzusetzen.
• Abtretung. Sie dürfen diese Bedingungen ohne unsere schriftliche Zustimmung nicht abtreten. Wir können sie im Rahmen einer Fusion, eines Erwerbs oder eines Verkaufs von Vermögenswerten abtreten.
• Höhere Gewalt. Wir haften nicht für Ereignisse außerhalb unserer zumutbaren Kontrolle (Ausfälle bei Upstream-Carriern, Naturkatastrophen, regulatorische Maßnahmen, Kriegshandlungen).
