1. Parties et contact

eSIMSupra (the "Service", "we", "us", "our") is operated by the legal entity trading as eSIMSupra, contactable at [email protected]. "You" means the adult purchaser or user of a plan.

Operator note: replace with your registered company name, address, jurisdiction of incorporation, and company number before commercial launch.

2. Éligibilité

You must be at least 18 years old (or the age of majority in your country of residence if higher) to purchase a plan. By placing an order you confirm you meet this requirement and that you have legal capacity to contract.

1. Service

Forfaits eSIM prépayés livrés numériquement.

Plan availability, included data, validity, speed, and supported carriers are listed on each plan page and may change over time. Network coverage is provided as-is and depends on local carrier infrastructure, your device's band support, and regional conditions beyond our control.

4. Commandes, tarifs et taxes

• Les prix sont affichés en USD par défaut et dans votre devise locale lorsque cela est supporté. Le prélèvement final est effectué en USD par notre processeur de paiement ; la conversion bancaire et les spreads de change échappent à notre contrôle.
• Les taxes, TVA ou GST, le cas échéant, sont soit incluses dans le prix affiché, soit ajoutées au checkout comme divulgué avant que vous ne confirmiez le paiement.
• Une commande devient définitive lorsque nous vous envoyons l'email de confirmation de commande. Nous nous réservons le droit de refuser ou d'annuler une commande si elle semble frauduleuse, viole des listes de sanctions ou est passée depuis une juridiction bloquée.

Livraison par email après paiement. Appareil compatible requis.

3. Remboursements

Refund eligibility is governed by our Politique de remboursement, which forms part of these Terms. Where EU/UK consumer law grants a 14-day right of withdrawal for digital goods, you acknowledge that activating the eSIM profile begins performance of the service and therefore extinguishes that right for the activated plan, in line with Article 16(m) of Directive 2011/83/EU.

8. Propriété intellectuelle

The website, brand, logo, site copy, design, and software are the intellectual property of the operator of eSIMSupra and its licensors. You receive a limited, personal, non-exclusive, non-transferable licence to use the service. Nothing in these Terms transfers ownership of any intellectual property.

9. Garanties et clauses de non-responsabilité

To the maximum extent permitted by applicable law, the service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory — including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that coverage, speed, or availability will be uninterrupted or error-free. Nothing in this section limits any warranty that cannot lawfully be excluded in your jurisdiction.

5. Limitation de responsabilité

To the maximum extent permitted by applicable law, our aggregate liability to you for any claim arising from the service is limited to the total amount you paid for the specific plan that gave rise to the claim within the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, missed bookings, roaming charges on your home carrier, or travel-plan disruption. Nothing in this section limits liability that cannot lawfully be limited, such as for death, personal injury caused by our negligence, or fraud.

11. Droit applicable et litiges

These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-law rules. Any dispute will first be attempted to be resolved by good-faith negotiation between you and us for at least 30 days. If that fails, disputes will be resolved by the courts of that jurisdiction, except where mandatory local consumer-protection law grants you a right to your local court. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Operator note: specify the exact governing law and forum (e.g. "laws of England and Wales, courts of London" or "laws of Delaware, state and federal courts of Delaware") before commercial launch.

12. Résiliation

We may suspend or terminate the service or your access to any part of it at any time for breach of these Terms, legal compulsion, or security reasons. Sections that by their nature should survive termination (intellectual property, warranties, liability, governing law) will survive.

14. Divers

• Divisibilité. Si une partie de ces Conditions est jugée inapplicable, le reste reste en vigueur.
• Intégralité de l'accord. Ces Conditions, ainsi que la Politique de confidentialité, la Politique de cookies et la Politique de remboursement, constituent l'intégralité de l'accord entre vous et nous.
• Aucune renonciation. Notre omission de faire respecter une disposition ne constitue pas une renonciation à notre droit de la faire respecter ultérieurement.
• Cession. Vous ne pouvez pas céder ces Conditions sans notre consentement écrit. Nous pouvons les céder dans le cadre d'une fusion, d'une acquisition ou d'une vente d'actifs.
• Force majeure. Nous ne sommes pas responsables des événements indépendants de notre volonté (pannes des opérateurs amont, catastrophes naturelles, mesures réglementaires, actes de guerre).
